Requesting/Inquiring: Requesting the City Attorney to draft an ordinance - Standards for and Regulation of Vacant Buildings:
102A.3 Vacant/Abandoned Building Inspection & Registrations
If a residential building is entirely vacant for more than 90 days, or a commercial/mixed-use building is entirely vacant for more than 1 years, the owner of record or agent designated on the Assessor's Records must register the building as vacant property with the Department of Building Inspection.
1. Annual Registration Fee. A $625.00 annual registration fee is required.
2. Liability insurance. The owner of record is required to maintain and provide proof of Liability Insurance coverage in the amount of $300,000 minimum for residential structures and $1,000,000 for commercial or mixed use structures.
3. Sign Postage. The property owner is required to post a sign no smaller than 8 ½ inches by 11 inches that is protected from the weather in a conspicuous location at the front of the building delineating current information containing the name, address, and phone number of the owner of record or authorized agent. If a notice of default or foreclosure has been recorded for the subject property the lender information must also be identified.
4. Maintenance of Vacant Property, Exterior. The property owner shall keep the premises clean by maintaining vegetation; removing weeds, debris, garbage, graffiti, maintain foundations, roofs, chimneys, flues, gutters, downspouts, scuppers, flashing, exterior stairs and decks.
5. Maintenance of Vacant Property, Interior. The property owner shall keep the building interior free from garbage, debris, rodent, pest or insect infestation, and plumbing or roof leaks.
6. Vacant Building Security, Building doors, windows, and openings may be secured with plywood panels for the first year. After the first year the plywood panels must be replaced with steel security panels or secured doors and windows and a commercially services 24-hour burglar alarm system approved by the building official.
Registration fee support:
$625.00 = 2.5 hours of inspector time @ $170.00 ($425.00) plus 2 hours administrative (clerical time) @ $104.00 ($208.00) = $625.00 in round numbers.
